There is a case of (potential) Nazi-looted art in the U.S. Supreme Court this term. It is Federal Republic of Germany v. Philipp (19-351) and it could confront the court with difficult questions having to do with the nature of the Holocaust. This is not the first time a case of Nazi-looted art has reached the Supreme Court. There was Republic of Austria v. Altmann, 541 U.S. 699 (2004), which raised the relatively narrow question of the retrospective applicability of the Foreign Sovereign Immunities Act to events that took place before it was enacted. The Philipp case arises under the Foreign Sovereign Immunities Act as well, but it raises a bigger issue about the applicability of the act to a case of potential Nazi-looted art. The story of the deceased pedophile and presumed Israeli spy Jeffrey Epstein continues to enthrall because so little of the truth regarding it has been revealed in spite of claims by the government that a thorough follow-up investigation has been initiated. The case is reportedly still open and it is to be presumed that Justice Department investigators have been able to examine certain aspects of what occurred more intensively. A major part of the investigation has been a review of actions taken by the four government prosecutors who were most directly involved with the negotiations with Epstein and his lawyers in 2007-8. The 22 month-long review, carried out by the Justice Department’s Office of Professional Responsibility (OPR), finally produced a 350 page report which was released on November 12th.
