The EU’s Link Tax Will Kill Open Access and Creative Commons News

All this month, the European Union’s “trilogue” is meeting behind closed doors to hammer out the final wording of the new Copyright Directive, a once-noncontroversial regulation that became a hotly contested matter when, at the last minute, a set of extremist copyright proposals were added and voted through.

One of these proposals is Article 11, the “link tax,” which requires a negotiated, paid license for links that contain “excerpts” of news stories. The Directive is extremely vague on what defines a “link” or a “news story” and implies that an “excerpt” consists of more than one single word from a news-story (many URLs contain more than a single word from the headline).

Article 11 is so badly drafted that it’s hard to figure out what it bans and what it permits (that’s why we’ve written to the trilogue negotiators to ask them to clarify key points). What can be discerned is deeply troubling.

One of the Directive’s “recitals” is Recital 32:

“(32) The organisational and financial contribution of publishers in producing press publications needs to be recognised and further encouraged to ensure the sustainability of the publishing industry and thereby to guarantee the availability of reliable information. It is therefore necessary for Member States to provide at Union level legal protection for press publications in the Union for digital uses. Such protection should be effectively guaranteed through the introduction, in Union law, of rights related to copyright for the reproduction and making available to the public of press publications in respect of digital uses in order to obtain fair and proportionate remuneration for such uses. Private uses should be excluded from this reference. In addition, the listing in a search engine should not be considered as fair and proportionate remuneration.” (emphasis added)

Once you get through the eurocratese here, Recital 32 suggests that (1) anyone who wants to link to the news has to have a separate, commercial license; and (2) news companies can’t waive this right, even through Creative Commons licenses and other tools for granting blanket permission.

Many news organizations allow anyone to link to their work, including some of the world’s leading newsgatherers: ProPublica (“ProPublica’s mission is for our journalism to have impact, that is for it to spur reform”), Global Voices (a leading source of global news written by reporters on the ground all over the planet), and many others. These Creative Commons news entities often rely on public donations to do their excellent, deep, investigative work. Allowing free re-use is a key way to persuade their donors to continue that funding. Without Creative Commons, some of these news entities may simply cease to exist.

Bauchladen für Muslime

Das Internetportal „Muslim-Markt“ wirkt auf den ersten Blick wie ein Bauchladen für alles, was Muslime gebrauchen können. Da gibt es unter anderem eine Liste mit Halal-Restaurants in Deutschland, ein eigenes Halal-Siegel für Unternehmen, Halal-Reisen und Gelatine. Für die würden „ausschließlich tierische Rohstoffe von halal geschlachteten (islamisch geschlachteten) und im Islam zum Verzehr erlaubten Tieren verwendet.“

Obendrein gibt es noch eine Liste mit muslimischen Gebetsstätten und eine „Enzyklopädie des Islam“. Alles auf Deutsch. „Muslim-Markt“ bezeichnet sich selbst als „Startpunkt zum Islam für deutschsprachige Gläubige“. Das ist alles erst einmal unverdächtig und für Muslime in Deutschland ein durchaus sinnvolles Angebot.

Anhänger des Mullah-Regimes

Ein Gemischtwarenladen mit reichlich Propaganda: Yavuz Özoguz betreibt „Muslim-Markt“.

Doch auf dem Portal gibt es noch mehr: Propaganda für das iranische Mullah-Regime. Da kann man Reden des iranischen Führers der „islamischen Revolution“ Imam Chamenei auf Deutsch finden, den Brief des Imam „an die Jugend in Europa und Nordamerika“ sowie den Internetsender „Muslim TV“. Über den werden Verlautbarungen des iranischen Regimes auf Deutsch verbreitet. Wirkt wie ein Außenposten der Mullahs in Deutschland. Damit wird ein Regime verherrlicht, in dem nach Angaben von Amnesty International die Meinungsfreiheit stark eingeschränkt ist, Folter und Misshandlungen von Gefangenen sowie Hinrichtungen an der Tagesordnung sind. Hinter der Propaganda für den Iran stecken die Brüder Gülkhan und Yavuz Özoguz aus dem niedersächsischen Delmenhorst.

Der niedersächsische Verfassungsschutz bestätigt gegenüber Panorama 3, bei dem Portal „Muslim-Markt“ handele es sich um „ein bundesweit bedeutsames schiitisches Internetportal“, dieses sei „dem schiitischen Islamismus zuzurechnen“. Die Özoguz-Brüder handeln keineswegs allein, sondern sind eingebunden in ein Netzwerk aus Vereinen, Moscheen und Gruppen, die als Anhänger des schiitischen Islamismus gelten. In diesem sind auch Hisbollah-Anhänger aus dem Libanon aktiv. Die Aktivitäten des Netzwerks erstrecken sich über verschiedene Städte im norddeutschen Raum. Neben Delmenhorst sind unter anderem Oldenburg, Bremen, Hannover und Hamburg betroffen.

Hass auf Israel

Die Vernichtung Israels ist Staatsdoktrin im Iran. Folglich fordern auch die Anhänger des Regimes in Deutschland die Vernichtung des Staates Israel. Dafür scheuen Islamisten auch nicht vor Bündnissen mit Rechtsextremisten zurück. Yavuz Özoguz bezeichnet im Internet den Iraner Mahammad-Ali Ramin als seinen „islamischen Lehrer“ und als „geliebten Bruder“. Ramin ist Holocaustleugner und Organisator der „Holocaustkonferenz“ im Jahr 2006 in Teheran. Auf dieser trafen sich Holocaustleugner und andere Rechtsextremisten aus der ganzen Welt.

Nachdem Yavuz Özuguz unsere Fragen zu seinen islamistischen Aktivitäten anfangs nicht beantwortet hatte, kam es doch noch zu einem Interview. In diesem distanzierte sich Özoguz von Ramin, wenn dieser ein Holocaustleugner sei. Wenig glaubwürdig, dass Özoguz die Aktivitäten des „geliebten Bruders“ nicht kennen will. Vielmehr weiß er offenbar sehr genau, was in Deutschland erlaubt ist und was nicht. Er will auch kein Antisemit sein, Juden seien seine Freunde. Uns gegenüber verkündet Özoguz, „die Ablehnung des Apartheitsstaates Israel“ sei kein Antisemitismus.

Härteres Vorgehen gefordert

„Eindeutig antisemitische Propaganda“: Felix Klein hat eine kalre Meinung zu den Aussagen auf „Muslim-Markt“.

Der Beauftrage der Bundesregierung gegen Antisemitismus Felix Klein kritisiert die antiisraelischen Aktivitäten der Islamisten um Özoguz scharf. Es sei eindeutig antisemitisch den demokratischen Staat Israel mit dem ehemaligen Apartheitsstaat in Südafrika gleichzusetzen. „Das ist eine bewusste Delegitimierung des Staates Israel.“

Die könne man so nicht stehen lassen. Darüber hinaus tauchen in der Propaganda der Islamisten immer wieder klassische antisemitische Verschwörungstheorien auf. Israel und Juden werden als blutrünstige Herrscher der Welt dämonisiert. Felix Klein fordert ein härteres Vorgehen gegen solche Propaganda. Die „bedroht die Grundfesten unsere Demokratie und hier muss der Staat sich wehren“.

Fineman grew up in Pittsburgh, in the community of Tree of Life Synagogue.  Early today when he was talking on MSNBC I could hear the heartbreak in his voice.

His column is called Shaking My Faith in America and on the Times website the subtitle is The bloodshed in the Tree of Life synagogue is a sign that hatred of The Other is poisoning our public life.

In his third and fourth paragraphs, he offers these words:

My response is grief, of course, and the immediate realization that this horror is part of a larger pattern of mayhem and hatred in America and around the world. Churches, minority communities, gay nightclubs, politicians and journalists are threatened. We live in an age of assault rifles, pipe bombs and bone saws.

But I also have to admit — and am grieved to admit — that the mass murder at Tree of Life has shaken my perhaps naïve faith in this country, one that I began developing as a boy growing up in Pittsburgh.

There is so much more.

Here are just two more paragraphs:

I was taught in Squirrel Hill that we were in the one country that was an exception to the history of the human race in general and the Jews in particular. Founded on Enlightenment principles of individuality, freedom, tolerance and justice, the United States was the only place besides Israel where Jews could live at one with their nation, unburdened by fear or confusion about identity.

Now I must wonder: If Pittsburgh isn’t safe for Jews, if Squirrel Hill isn’t safe, if the Tree of Life isn’t safe, what place is? Without diminishing anyone else’s suffering and death, it’s a sad fact that the Jews often are the canaries in the coal mine of social and political collapse. So, what does the bloodshed in the Tree of Life mean?

For many of Jewish heritage, there have to be some doubts right now.  If the President, with Jewish grandchildren, cannot recognize the threat his rhetoric presents to those of Jewish faith or heritage, if he cannot recognize that the son who bears his name regularly retweets things with memes that are clearly anti-Semitic, if he cannot realize the horror is unleashing, it is totally reasonable for those of us of Jewish background might question our faith in America.

My family came to this country from Poland and Lithuania, starting in 1862 and ending in 1906.  They came believing this was a place where they would be safe from persecution because of their religion. When I look through my extended family, full of lawyers and teachers and judges and businessmen and social workers and stockbrokers, in some sense we were able to rise from our immigrant roots and participate in the American dream.

But all of us are shaken after this worst atrocity against American Jews in our history.  And yet after all this the President chooses to attack by name a prominent American Jew who criticizes him, Bill Kristol.

And yet those of us of Jewish origin somehow remain incredibly optimistic.  We have somehow survived despite millennia of persecution.  We most often speak up for others who face the kinds of discrimination that are so much a part of our collective history.

So let me offer Fineman’s last paragraph, which has within it the inevitable Jewish optimism:

I only hope that the martyrs of the Tree of Life — like those in Charleston, Charlottesville and other mass shootings motivated by hate — did not die in vain. America’s gifts are not easily preserved — even, I now know, in Squirrel Hill.
